Terms of Service

Please read these Terms of Service ("Terms") carefully before using the services provided by Direct Connect Global ("DCG," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
1. Description of Services
DCG provides telecommunications services that enable family members to communicate with incarcerated individuals through text messaging, voice messaging, and phone calls ("Services"). Our Services include:
- Monthly subscription plans for unlimited messaging
- Text and voice message delivery to and from correctional facilities
- A web-based portal for managing messages and account settings
- Phone-based access for incarcerated individuals via toll-free numbers
2. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use our Services. By subscribing, you represent and warrant that you meet these requirements.
3. Account Registration
- You must provide accurate, current, and complete registration information
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
3.1 SMS Consent and Program Terms
Direct Connect Global offers mobile messaging services to send transactional and operational alerts, billing notifications, account setup support, and messaging updates. By providing your phone number and checking the SMS opt-in consent box during registration or checkout, you agree to receive SMS/MMS messages and service calls from us.
- Opt-In: You opt in to our messaging program by checking the consent box during registration/checkout, or by sending keywords like START or UNSTOP. Consent is not a condition of purchase.
- Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to our shortcode or phone number. Reply STOP to opt out. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time or text "START" or "UNSTOP" and we will start sending SMS messages to you again.
- Help & Support: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance. Reply HELP for help. Or you can get help directly at support@directconnectglobal.com.
- Message Frequency & Rates: Message frequency varies based on your account activity and inmate messaging volume (typically up to 5 messages/month for administrative alerts). Message and data rates may apply for any messages sent to you from us and to us from you.
- Carrier Disclaimer: Mobile carriers are not liable for delayed or un-delivered messages.
4. Subscription and Payment
4.1 Pricing
Subscription plans and pricing are displayed on our checkout page. Prices may change with 30 days advance notice to active subscribers.
4.2 Billing
- Subscriptions are billed monthly through Stripe, our payment processor
- Payment is due at the start of each billing cycle
- Failed payments may result in service suspension
4.3 Cancellation and Refunds
- You may cancel your subscription at any time through your account settings or by contacting us
- Cancellation takes effect at the end of your current billing period
- Refunds are issued at our discretion and on a case-by-case basis
5. Acceptable Use
You agree not to use our Services to:
- Transmit content that is illegal, threatening, harassing, or defamatory
- Plan, facilitate, or coordinate criminal activity
- Impersonate another person or entity
- Transmit malware, spam, or unsolicited communications
- Attempt to circumvent facility rules, regulations, or security protocols
- Share account credentials with unauthorized individuals
- Use automated systems to access the Services (bots, scrapers, etc.)
6. Content Monitoring
You acknowledge and agree that:
- Messages sent through our Services may be subject to monitoring and recording as required by correctional facility policies and applicable law
- We may review, flag, or block content that violates these Terms or applicable laws
- We may be required to share communication records with law enforcement pursuant to valid legal process
7. Service Availability
- We strive to maintain 99.9% service uptime but do not guarantee uninterrupted access
- We may temporarily suspend Services for maintenance, upgrades, or security reasons
- Service availability may be affected by factors outside our control, including facility policies and telecommunications infrastructure
8. Intellectual Property
All content, trademarks, software, and materials on our platform are owned by or licensed to DCG. You may not copy, modify, distribute, or reverse-engineer any part of our Services without written permission.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- DCG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR DELAYS OR FAILURES IN MESSAGE DELIVERY CAUSED BY FACILITY POLICIES OR THIRD-PARTY SERVICES
10. Indemnification
You agree to indemnify and hold harmless DCG, its officers, directors, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms of Service
- Your account is used for fraudulent or illegal activities
- Payment obligations are not met after reasonable notice
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in New Jersey.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email to active subscribers at least 30 days in advance. Continued use of the Services after changes take effect constitutes acceptance of the modified Terms.
